Terms
‘Company’
referred to in this document shall mean Linguascope.
‘Buyer’ shall mean the
person/company or the persons/companies servants or
agents ordering goods/services from the
company.
‘Contract’ shall mean the agreement entered
into between the company and the Buyer to supply
goods/services to the buyer.
‘Goods’ shall mean any
goods/services that are the subject of any contract and
shall include labour, components and any part(s) of
components supplied and any materials incorporated in
them.
These conditions supersede all previous
releases. They prevail in the event of any variances
within the Buyers terms and conditions of
purchase.
These terms and conditions are subject
to change without notice. We advise the Buyer to
regularly check these terms and conditions.
The
Contract shall be governed by the laws of England and
Wales and the Parties agree to the non-exclusive
jurisdiction of the courts of England and Wales.
Prices
Prices are in accordance
with the company’s current price list or accepted
quotation.
Quotations are valid for 30 days. The
Company deserves the right not to accept the Buyer’s
orders either in the quotation period or after its
expiry.
Price lists are subject to alteration without
notice.
Payment
Unless otherwise agreed
invoices are payable within 30 days of the date of
invoice.
If before delivery is made the Company has
reasonable grounds for doubting the Buyers ability to
pay or if any sums owing by the Buyer to the Company are
overdue for payment then the Company deserves the right
to demand payment prior to delivery, to cancel any
agreement, or to take action as may appear to be
appropriate.
Deliveries
Deliveries will be
made in accordance with the Buyers instructions. In
their absence the Company’s best judgment will
apply.
Claims for non-delivery or complaints must be
made in writing within 10 days from receipt of the
invoice.
Transportation damage must be reported to
the carrier at the time of receipt of the Goods and to
the Company within 24 hours of receipt of the
Goods.
Insurance claims must be handled by the
Insurer.
The Company shall not be liable for any
delay or failure to deliver from causes beyond its
reasonable control, including but not limited to, Acts
of God or public enemies, civil or military authority,
accidents, fires, explosions, floods, epidemics,
strikes, labour disputes and shortages of materials or
transportation.
Returns
Unwanted goods must be
returned in original packaging and in mint condition
within 7 days of receipt for a refund. We reserve the
right to charge for the cost of postage, packaging and restocking.
We will not accept returns of unwanted goods
after 7 days of receipt.
Returns should be addressed to Linguascope. For order values of more than £50, we advise the
Buyer to return the goods by a recorded delivery
service.
The Buyer is responsible for the cost of returning
unwanted goods.
Warranties
The Company warrants
that products or parts sold under the terms and
conditions conform to the Company’s specifications and
are free from defects in material or
workmanship.
This warranty which includes both labour
and materials extends for a period of 6 months from the
date of shipment.
The warranties implied herein are
conditional upon the goods being used in accordance with
the Company’s recommendations.
Defective products
must be returned carriage prepaid to the Company’s
premises for credit or replacement at the Company’s
option. The Company must be informed before any Goods
are returned.
Except for warranty of title the
warranty set forth above is exclusive and in lieu of all
other conditions, terms and warranties expressed,
implied in fact or by statute, operation of law or
otherwise, including the implied warranty if fitness for
a particular purpose or merchantability. The Company
shall have no other obligation or liability to any
person, whether hereunder or otherwise in connection
with or resulting from the sale of the product or
services supplied by it. In no event shall the Company
be liable for special indirect collateral or
consequential damages hereunder such as, but not limited
to, loss of anticipated profits or other economic loss
in connection with or arising out of the existence of
the use of any product sold hereunder.
The liability of the Company for any claim, including
but not limited to claims for negligence, arising out of
or connected with its performance hereunder, claims with
respect to the manufacture, delivery, sale, resale,
lease or use of any product sold hereunder and claims
arising from breach of contract or warranty shall in no
case exceed the unit price paid by the Buyer to the
Company for the particular unit involved in the claim.
Title
1) Products supplied by the
Company shall be at the Buyer’s risk immediately upon
delivery to him or to a carrier on his behalf.
2)
Unless other wise notified in writing to the |Buyer
until the products have been paid for in full together
with any interest and all other sums from the Buyer the
Products shall remain the property of the Company and
the Buyer shall store the Products in such a way that
they can be identified as the property of the Company
and indisposing of them shall do so only for the
Company’s account subject to number 3 below
3) If the
Buyer shall sell or dispose of the products to any third
party before the price any interest and all other sums
due from the Buyer have been paid in full he shall do so
as principle and shall not give any warranties nor
include any liability on behalf of the Company in
connection with the sales or disposal of the Products
and any proceeds resulting there from (or claim thereto)
shall belong to the Company to the extent of sums due
from the Buyer to the Company.
4) If the Products are
used as a component in the production of other Goods, or
as part of a mixture of other Goods then such other
goods shall belong to the Company to the extent of all
sums due from the Buyer to the Company.
5) Failure by
the Buyer to make payment in full or on the due date for
the Product shall give the Company the right without
prejudice to any other remedies to repossess the
Products or any other Goods of which they have been used
as a part or component with or without prior notice and
to enter upon any premises on which the Products or
other such Goods may be for the purpose of
repossession.
6) At any time after delivery of the
Products the Company shall have the right to sue the
Buyer for the contract price together with interest and
all other sums due from the Buyer notwithstanding any
other provisions hereto.
7) Buyers shall not reverse
engineer or make derivatives of the Products in order to
compete with the Company.

Collection of
information
Linguascope adheres to the highest standards of privacy and does not share any information about our users to third parties.
Linguascope does NOT:
- collect any information from students using its websites.
- post anywhere on its websites any email that is sent to or from our users (unless permission is granted – ie. testimonials section).
- send any mass emails, updates, or advertisements to Buyers (unless they opt to subscribe to our newsletter).
The information that we collect:
Linguascope collects a minimal amount of information from Buyers in order to record their orders. Our database holds the following information:
- School name
- Contact name
- School address
- School fax number
Linguascope uses the above information to occasionally send schools information by post about our other products (currently once a year). If you'd rather not receive such information, let us know by contacting us.
